Copyright Registration in Guatemala: Protecting Creative Works
Learn how to register literary, artistic, musical, or software works in Guatemala under the Copyright and Related Rights Law.
## What is copyright?
Copyright protects literary, artistic, musical, audiovisual, and software works against unauthorized reproduction, distribution, or exploitation. In Guatemala, it is regulated by the **Copyright and Related Rights Law (Decree 33-98 of the Congress of the Republic)**.
An important feature: copyright arises automatically upon creation of the work (it does not require registration to exist), but registration with the **Copyright Registry** provides evidentiary value and facilitates legal defense.

## Step-by-step process
### Step 1: Prepare the documentation
Gather:
- Copy of the work (physical or digital depending on the type)
- Author identification (DPI or passport)
- If the applicant is not the author: document proving representation or assignment of rights
### Step 2: File the application
File with the **Copyright Registry** (within the Ministry of Culture and Sports) including:
- Application form
- Copy of the work
- Author identification
- Proof of fee payment
### Step 3: Examination
The Registry reviews whether the application meets formal requirements and whether the work is protectable.
